If you are a Landlord, Letting Agent or in charge of or responsible for a property then you may have an obligation under Health & Safety law to have a Legionella Risk Assessment carried out. There is a common misbelief that Domestic Rented Properties do not need a risk assessment if they do not have a Cold Water Storage Tank or if they use a Combi Boiler. This is not the case. The HSE ACOP L8 covers all aspects of hot and cold water systems regardless of how they are heated, stored or used.
The Health & Safety Executives issued the 4th Edition Approved Code of Practice for the Control of Legionella Bacteria ACOP L8 in 2013. This 4th Edition effectively removed an artificial limit on the size of water systems that the ACOP L8 covered. As a result, smaller systems, typically those found in domestic properties fell within the scope of the ACOP L8.
In general terms most Domestic Rented Properties are in the low risk group for developing Legionella bacteria. This is mainly because it is expected that there will be regular water usage, outlets will be kept clean by those living there and water heaters and associated fittings will be serviced on a regular basis.
What Action Do We Need to Take? - Those in charge of or responsible for a property should ensure the minimum requirements of the ACOP L8 are in place which includes a valid Legionella Risk Assessment (carried out within the last two years). The risk assessment will recommend if further measures are required.
